Terms of Service

This English version is provided for reference only. The Japanese version of these Terms of Service shall be the official and legally binding version. In the event of any inconsistency or discrepancy between this English version and the Japanese version, the Japanese version shall prevail.
Your Statutory Rights. Nothing in these Terms shall affect any mandatory rights you may have as a consumer under the laws of your country of residence. Where any provision of these Terms is found to be contrary to such mandatory consumer protection laws, that provision shall be limited to the minimum extent necessary so that the remaining provisions remain enforceable.
Article 1 (Overview of the Service)
"Gemix" (the "Service") is a professional trading card grading service operated by Corrado Co., Ltd. ("we," "us," or "our"). The Service evaluates the authenticity, value, and condition of trading cards submitted by users using our specialized knowledge and techniques, and provides the resulting grading information.
Article 2 (Definitions)
(1) "Terms" means these Terms of Service together with any additional terms, guidelines, and conditions of use posted on our website that we may separately establish, all of which apply to the use of the Service.
(2) "User" means an individual or legal entity that has agreed to these Terms, provided the required information in accordance with our prescribed procedures, and completed registration to use the Service.
(3) "Grading" means the process of evaluating and certifying the authenticity, condition, market value, and other attributes of trading cards submitted by Users.
Article 3 (User Registration)
(1) To use the Service, Users must agree to these Terms and complete the registration process by providing accurate information as required by us.
(2) Where a minor wishes to register for the Service, the express consent of their legal representative is required. Without such consent, registration shall be invalid.
(3) Only one account may be registered per address or household. If we identify multiple accounts registered from the same address or household, we may suspend or delete the duplicate accounts.
(4) We reserve the right to refuse registration where the applicant may violate these Terms, where fraud is suspected, or where we otherwise deem the registration inappropriate.
Article 4 (Account Management)
(1) Users are responsible for carefully managing their account information. Allowing third parties to use, transfer, or lend account information is strictly prohibited.
(2) Users shall be solely responsible for any damages arising from unauthorized use or leakage of their account information. Except in cases of our willful misconduct or gross negligence, we shall not be liable for any leakage or unauthorized use of account information attributable to the User.
Article 5 (Use of the Service)
(1) Users may apply for trading card grading through the Service. Applications require the provision of necessary information and completion of the prescribed procedures.
(2) Grading results are determined based on our professional grading standards. The results will be communicated to the User, upon which the grading is deemed complete.
(3) The final determination of grading results rests solely with us. Users may not dispute grading results or make detailed inquiries regarding the grading process. Provided, however, that where a manifest error is identified in the grading result, we will perform a re-grading at our cost and return the result to the User.
Article 6 (Cancellation and Restrictions of Applications)
(1) Applications meeting any of the following conditions may be canceled. Repeated violations of these conditions, or other circumstances we deem appropriate, may result in refusal of future applications, account restriction, suspension, or deletion. Where an application is canceled, no payment will be processed.
Cards submitted that are not eligible for grading
Discrepancy between cards declared online and cards actually received
Application form (PDF) not enclosed with the shipment
Cards not stacked in declared order (smallest number on top)
Cards not received within 10 business days of application
Improper use of first-order partner program discounts (including duplicate use by the same address, household, or related parties)
Multiple applications from the same address
(2) Due to the nature of the Service, cancellations for the User's convenience are, as a rule, not accepted.
(3) Cards received after a cancellation will be returned to the User by cash-on-delivery shipping.
(4) Where eligible and ineligible cards are submitted together, the ineligible cards will be returned together with the graded items. In such cases, fees at the service level declared at the time of application will still apply to the ineligible cards.
Article 7 (Prohibited Acts)
(1) Users are strictly prohibited from engaging in any acts that violate laws or regulations, are contrary to public order or good morals, interfere with our operation of the Service, or cause nuisance to other Users.
(2) Where a User violates the preceding paragraph, we may suspend or delete the account, restrict use of the Service, or take any other measures we deem necessary, without prior notice. We shall not be liable for any damages arising from such measures.
Article 8 (Exclusion of Anti-Social Forces)
(1) Users represent and warrant that they are not, and will not be, affiliated with organized crime groups, members thereof, related enterprises, racketeers, or any other anti-social forces ("Anti-Social Forces"), and that they have no relationship with Anti-Social Forces.
(2) Users agree not to engage, directly or through third parties, in any violent demands, unjust demands beyond legal responsibility, threatening conduct in business dealings, use of violence, dissemination of false rumors, fraudulent or forceful conduct that damages our credit or interferes with our operations, or any similar acts.
(3) Where we determine that a User has violated the preceding paragraphs, we may immediately suspend the provision of the Service or terminate this contract without any notice.
(4) Even where this contract is terminated under the preceding paragraph, we shall bear no liability for damages to the User. The User shall bear all damages they may incur.
Article 9 (Modification, Suspension, or Termination of the Service)
(1) We may modify, suspend, or terminate the Service for purposes such as quality improvement, system updates, or other operational reasons. We will notify Users of such changes as appropriate.
(2) Where the Service is temporarily difficult to provide due to system maintenance, unforeseen accidents, force majeure, or similar causes, we may suspend the Service. In such cases, we will endeavor to give prior notice but may be unable to do so in urgent circumstances.
Article 10 (Eligible Trading Cards)
(1) The Service applies only to trading cards from specific brands printed in Japanese or English. Details of eligible card brands are provided on our website. Cards must meet the prescribed size requirements and must not be enclosed in card holders from which removal is difficult.
(2) We may decline to grade cards suspected of being trimmed, recolored, restored, signed, error cards, otherwise improperly altered, counterfeit, or oversized. To protect our grading techniques, we cannot disclose specific reasons or details for such determinations. These cards will be deemed ineligible and returned without grading. Please note that return shipping fees and grading fees at the service level declared at the time of application will still apply.
(3) Cards deemed ineligible will be returned at the User's expense. Even in such cases, return shipping fees and grading fees at the service level declared at the time of application will apply.
Article 11 (Handling of Stolen or Illegally Obtained Goods)
(1) If, during the grading process, we suspect that a card is stolen, lost property, obtained through fraud or other criminal acts, or otherwise traded in violation of law (collectively, "Illegally Obtained Goods"), we reserve the right to immediately cease grading.
(2) In such cases, we may provide information about the cards and the User to the police, other investigative agencies, rightful owners, or their representatives, and cooperate with investigations. The User consents in advance to such disclosure.
(3) Where cards are determined to be Illegally Obtained Goods, we may refuse to return them and may deliver them to the rightful owner. In such cases, we will not issue any refund or compensation to the User.
(4) Users represent and warrant that any cards submitted for grading are their lawful property and are not Illegally Obtained Goods.
(5) We shall not be liable for any damages arising to the User in connection with this Article (including damages from refusal to return cards). Where the User's submission of Illegally Obtained Goods causes damage to us or any third party, the User shall be responsible for compensating all such damages.
Article 12 (Grading Content and Methods)
(1) The Service simultaneously offers two types of grading: "Authenticity Grading," which determines whether a card is genuine, and "Grading," which comprehensively evaluates the card's quality, condition, and rarity.
(2) We cannot respond to individual inquiries about grading methods or standards. We may revise our grading standards as our techniques evolve.
(3) Graded trading cards are sealed in dedicated holders together with captions containing information such as brand, series, card name, card number, year of issue, and rarity. Holders are designed to minimize stress on the card. Slight movement of the card within the holder is by design. Complete prevention of deterioration is not guaranteed.
(4) The QR code on the back of the caption links to the grading page.
(5) Information on captions follows our standardized format. Long card names may appear in abbreviated form.
(6) We cannot, under any circumstances, retake images of cards after photography or after they have been encased.
(7) Where a Minimum Grade ("MG") has been set and the card does not meet the specified grade, the card will be returned in its current state without being encased. No grading number or grade will be assigned. The application detail page will display "MG Not Met." Fees at the service level declared at the time of application will still apply.
(8) For Crossover Service, the original case will always be removed for grading and will not be returned (the same applies when MG is set).
(9) In Grading Reports, where the number of defects exceeds a certain threshold, defects with the greatest impact on the grade will be listed with priority. Defects with smaller impact may not be recorded.
(10) For Grading Reports of cards with grades below 9 and a certain number of identified codes, the layout will automatically switch to a simpler format to improve readability.
(11) The wording and terminology used in Grading Reports may be updated at our discretion.
(12) Updates to grading terminology or Grading Reports will not be retroactively applied to previously graded items.
(13) Captions, holders, cases, and similar elements are subject to change in wording, layout, or design without prior notice for reasons such as service improvement or manufacturing requirements. We bear no obligation to provide notice or guarantee regarding such changes.
(14) Even where design changes referenced in the preceding paragraph result in differences between previously graded items and current ones, we shall have no obligation to reissue, re-holder, or otherwise remediate the previously graded items.
Article 13 (Grading Fees and Payment)
(1) Service fees are listed on our website. Late payment interest accrues at an annual rate of 14.6%.
(2) Upon completion of grading, payment is processed automatically using the credit card information provided at the time of application. Fees at the service level declared at the time of application apply even for cards deemed ineligible or that fail to meet the MG.
(3) Where credit card payment fails, a storage fee of 1,000 yen per day will apply. Where the delay reaches 25 days, ownership of the cards is deemed waived; however, storage fees will continue to accrue.
Article 14 (Use of Grading Data)
(1) We may collect information from graded trading cards and use it for purposes such as improving the quality of the Service and for advertising and promotional purposes. Users' personal information will not be made public.
(2) The condition of cards upon arrival and the work process are recorded and preserved (not made public).
(3) Users consent to our collection and use of grading data (including images).
Article 15 (Intellectual Property Rights)
(1) All copyrights and other intellectual property rights in images, Grading Reports, grading numbers, captions, and any related deliverables produced through the grading process belong to us.
(2) Users may freely use the deliverables described in the preceding paragraph for commercial or non-commercial purposes, including for resale, display, social media posts, or publications. We welcome Users' active use of these deliverables.
(3) However, the following acts are prohibited. Where we determine that a User has engaged in any of these acts, we may take measures including injunctive relief.
Use in a manner that damages our credibility or reputation
False representation of grading results through alteration or modification of images, Grading Reports, etc.
Use of another party's grading results as one's own, or impersonation
Use for purposes contrary to public order or good morals
Creation or distribution of grading results not provided by us
(4) We may use grading images and related data for purposes including promotion of the Service, advertising, quality improvement, and research and development of grading techniques.
Article 16 (Delivery and Inspection)
(1) The estimated time from our receipt of cards until notification of grading completion and shipment of the graded items is, as a rule, approximately 30 business days.
(2) The estimated time from our receipt of cards until we notify the User of receipt is approximately 5 business days.
(3) Where notification of grading completion is expected to be significantly delayed beyond the schedule, we will provide separate individual notice to the User.
(4) Where multiple orders are returned together in a single shipment, we do not issue refunds or adjustments of shipping fees.
(5) Upon receipt of graded items, Users shall promptly verify that the quantity, type, and contents of the trading cards are correct and complete. Any discrepancies must be reported to us within 5 business days of receipt.
(6) Where the User fails to contact us within the foregoing period, we shall bear no responsibility for any such discrepancy.
(7) Return shipping fees for graded trading cards shall be borne by the User. For shipments within Japan, a flat rate applies as disclosed on our website. For international shipments, return shipping fees vary based on destination and weight, and the applicable amount will be calculated and displayed on the order confirmation screen at the time of application.
Article 17 (Compensation and Disclaimer)
(1) While we exercise the utmost care in providing the grading service, except in cases of our willful misconduct or gross negligence, we shall not be liable for any damages to a User's cards arising in connection with use of the Service.
(2) In the unlikely event of damage to a User's cards due to our negligence, compensation shall be limited to the service level applied for, calculated based on the market value of the card in its un-graded state (including for Crossover), with the difference between such value and the amount we determine paid to the User. The User may not dispute such determination. Cases involving foreign material contamination or scratches to the case will be handled by re-holdering.
(3) Compensation requests must be made within 5 business days of receipt of the shipment. Requests made beyond this period will not be eligible.
(4) The following are excluded from compensation:
Loss or damage due to natural disasters, man-made disasters, or theft
Loss or damage during transportation (both shipping and return)
Applications using packaging methods other than those prescribed by us
Cards with high inherent damage risk due to material or manufacturing era
Metal cards
Microscopic scratches or stains (particularly on edges or corners) that may occur during work
Microscopic abrasions or inclusions of 3 mm or less that are unavoidable in the manufacturing process
Abrasions or stains on stainless labels, and misalignment or tilt of engravings
Bubbles, micro-scratches, or protrusions arising from the grading holder manufacturing process, and their effects on cards
Damage to the holder caused by the User removing the holder sleeve
(5) We do not provide re-holdering for the User's convenience, whether for a fee or otherwise.
(6) We make no warranty regarding fluctuations in the market value of graded trading cards.
(7) We bear no responsibility and will not intervene in disputes between Users arising from use of the Service.
(8) To prevent fraud, where false or malicious inquiries about the content of compensation, or related social media posts, are discovered, we may take measures including refusing future applications and pursuing legal action.
Article 18 (Force Majeure)
(1) Where we are unable to perform all or part of our obligations under these Terms due to any of the following events ("Force Majeure Events"), we shall bear no responsibility for such non-performance:
Earthquakes, tsunamis, typhoons, floods, fires, and other natural disasters
War, civil unrest, riots, and acts of terrorism
Epidemics, pandemics, and related governmental requests or orders
Major failures of power or communications infrastructure, cyber attacks, and large-scale system failures
Enactment, amendment, or abolition of laws, and orders or actions by governmental agencies
Failures of logistics services or interruption of transportation
Other events beyond our reasonable control
(2) Where a Force Majeure Event occurs, we will promptly notify Users to the extent reasonably practicable.
(3) Where a Force Majeure Event causes delays in grading work, the delivery period prescribed in Article 16 shall automatically be extended for the duration of the Force Majeure Event.
(4) Even where a Force Majeure Event causes damage to our storage facilities and consequently to a User's cards, we shall bear no responsibility for compensation.
Article 19 (Confidentiality)
Users shall not disclose to or use for the benefit of any third party any confidential information of ours that they may come to know in connection with the Service. This confidentiality obligation shall continue after termination of the Service.
Article 20 (Handling of User Information)
(1) We will manage personal information provided by Users with strict care and handle it in accordance with our Privacy Policy.
(2) User information will be used solely for the purposes of improving the quality of the Service, developing new services, and other purposes that benefit Users.
Article 21 (Partner Services)
The Service may include services or content provided by our partners. Those services are operated by their respective providers under their own terms and conditions.
Article 22 (Cookies)
We may use cookies on our website to improve usability and operate our site effectively when Users visit.
Article 23 (Method of Communication)
(1) Inquiries and notices from Users regarding the Service shall be made through the official communication channels we designate.
(2) Notices from us to Users shall be made by email, posting on our website, or other means we deem appropriate.
Article 24 (Assignment of Contractual Status)
(1) Users may not transfer their rights or obligations under the Service contract to any third party without our prior written consent.
(2) Where we transfer all or part of our business related to the Service to a third party, we may transfer to the assignee our contractual position, rights and obligations, and User information in connection with such business transfer.
Article 25 (Modification of Terms)
(1) We may modify, add to, or delete these Terms without prior notice based on operational necessity, changes in law, market conditions, or similar reasons. The revised Terms will be communicated by posting on our website or other appropriate means.
(2) The latest version of these Terms is always available on our website. By using the Service, Users are deemed to have agreed to the most recent version of the Terms.
Article 26 (Severability)
Even where any provision or part of these Terms is determined to be invalid or unenforceable by law or by a court, the remaining provisions and the enforceable parts of the affected provision shall remain in full force and effect.
In such cases, we and the User shall negotiate in good faith to replace the invalidated or unenforceable provision with a valid and enforceable one that most closely reflects the original intent.
Article 27 (Entire Agreement)
These Terms constitute the entire agreement between us and the User regarding the use of the Service, and supersede all prior written or oral agreements, understandings, representations, and warranties relating to the subject matter of these Terms.
Article 28 (Governing Law and Jurisdiction)
(1) These Terms shall be governed by and construed in accordance with the laws of Japan.
(2) Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Yokohama District Court as the court of first instance.
(3) Notwithstanding paragraphs (1) and (2) above, where mandatory consumer protection laws of the User's country of habitual residence (including, without limitation, the laws of European Union member states pursuant to Regulation (EU) No 1215/2012 (Brussels I Recast) and Regulation (EC) No 593/2008 (Rome I)) provide the User with non-derogable rights regarding choice of law or forum, those mandatory rights shall prevail to the extent required by such laws.
Article 29 (Language)
These Terms are originally executed in Japanese. This English version is provided for reference only. In the event of any inconsistency or discrepancy between the Japanese and English versions, the Japanese version shall prevail.
